Additional charges apply for assessments requested by the client. All fees exclude VAT.

Guarantee period — refund structure

If a candidate leaves within the guarantee period and a replacement cannot be placed within four weeks, the following refund applies:

Candidate leaves in month 150% refund
Candidate leaves in month 235% refund
Candidate leaves in month 325% refund

Written notification required within 7 calendar days of the candidate's departure to activate the guarantee. Re-engagement of the same candidate within 12 months attracts the full placement fee.

Acceptance of terms

These Terms and Conditions constitute a binding agreement between Global Talent Connection (Pty) Ltd ("the Agency") and the Client. By digitally signing this document via the GTC platform, the Client acknowledges it has read, understood, and accepted these terms.

Services offered

The Agency provides specialist recruitment services for skilled tradespeople in FMCG, logistics, and commerce sectors across South Africa and internationally. Services include candidate sourcing, skills verification, assessment, and placement.

Introduction validity

An introduction is valid for 12 months from the date first made. If the Client employs any introduced candidate within this period — directly, through a third party, or through any associated entity — the applicable fee is due in full.

Client responsibilities

The Client must provide accurate job descriptions and role requirements, notify the Agency promptly of any changes to employment offers, and adhere fully to all agreed contractual obligations.

Candidate confidentiality and non-solicitation

All candidate profiles, CVs, and information accessed via the GTC platform are the confidential and proprietary information of the Agency. By signing this agreement, the Client agrees not to contact, approach, solicit, or engage any candidate whose profile or CV was accessed via the platform, other than through the Agency.

Any direct approach to a candidate identified via the GTC platform constitutes a material breach of this agreement. Upon such breach, the full applicable placement fee becomes immediately due and payable, regardless of whether a formal placement was made by the Agency. This applies whether the Client approaches the candidate directly or through a third party.

This clause operates in addition to the 12-month introduction validity period. Both protections apply simultaneously.

Payment terms

Permanent placements: 14 days from invoice (extendable to 30 days by prior written agreement). Short-term contracts: 14 days from invoice — no extension applies. Late payment attracts an administration fee of R850.00 (excl. VAT) plus interest at 2% per month (24% per annum), compounded monthly.

Confidentiality and data protection (POPIA)

The Agency operates as a Responsible Party under POPIA. Candidate information is used solely for matching to vacancies. The Client must handle all candidate information in strict confidence and use it only for evaluating candidates for the specific vacancy briefed.

Liability

The Agency undertakes reasonable due diligence but disclaims all liability for any loss, damage, or expense arising from the performance or non-performance of a placed candidate following the Commencement Date.

Termination

Either Party may terminate this Agreement with 30 days' written notice. Termination after the Client has accepted a candidate — verbally or in writing — requires payment of the full applicable placement fee.

Dispute resolution

Disputes not resolved within 14 calendar days shall be referred to mediation or arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA). Seat of arbitration: Cape Town, South Africa.

Governing law

This Agreement is governed exclusively by the laws of the Republic of South Africa.
